The Terms and General Sales Conditions described below apply to all orders placed with Glamour Cristalino Unipessoal Lda and to all the items and services provided onwww.ritagoesby.com, and describe the rules and regulations for its access and use.

Glamour Cristalino Unipessoal Lda., reserves all rights to change the Terms and General Sales Conditions at any given time. The Terms and General Sales Conditions that apply to the transactions taking place, are those available on the website at the time of placing the order.

These conditions are those agreed on between the above-mentioned company Glamour Cristalino Unipessoal, Lda, and anyone placing an order on the RITAGOESBY, website, hereinafter designated as “User/Customer”.

The parties agree that their relationship shall be exclusively governed by the general conditions described.

The Terms and General Sales Conditions are fully available on the website, where they can be viewed by the User/Customer.

Therefore, any order implies prior consultation and explicit acceptance of these Terms and Conditions, without exception, as well as of the payment methods and charges for handling and delivery.

The website RITAGOESBY is in compliance with the current practices and uses for the e-commerce sector.

I – CUSTOMER

The veracity and accuracy of the personal information made available and registered by the User/Customer are of his/hers entire responsibility and Glamour Cristalino Unipessoal, Lda. cannot be held liable for any problems stemming from unreliable or insufficient information, namely the inability to deliver orders.

II – PRODUCTS

The products on sale are those displayed on the website the moment the User/Customer places the order, subject to available stock. Glamour Cristalino Unipessoal, Lda. will include as much information about the products listed on the website as possible (photos, description, materials, colours, etc.), so that the User/Customer can make educated purchases. Nevertheless, there might be occasional, non-substantial mistakes that can be clarified either by the company or the User/Customer.

With the exception of exchanges due to sizing, in which one product is exchanged by another of a different size, free of charge, all returns will have an additional cost of € 10.00 (ten euros). This amount can be converted into credit for a new order placed at that time. Only original products that have not been worn (show no signs of being worn) will be accepted. All items will be thoroughly inspected and analysed.

If a product is not in accordance with your order or meets the description on the website at the time of the order, the User/Customer has the right to file a complaint with Glamour Cristalino Unipessoal, Lda. The company will then take the case under careful consideration. In the event the claim is justified, the User/Customer is entitled to exchange the product or get a full or partial refund of the purchase price.

III – ORDERS

In order to place an order on the website, the User/Customer must complete the different purchase and validation stages, which includes accepting the Terms and Conditions in their entirety.By finalizing and placing the order the User/Customer will be tacitly and fully accepting the general purchasing terms and conditions, prices and the descriptions of the products being purchased. These general purchasing terms are considered to be the only applicable agreement between the parties.

After placing an order, the User/ Customer will receive a confirmation email. This email will include the identification, description, availability, quantity, price, freight and delivery point.

RITAGOESBY reserves the right to refuse an order, if, by any reason, there are grounds to believe the order cannot be fulfilled securely and effectively for both parties.

Customer invoices will be available on the website’s “My Account” menu item.

IV – PRICES/TERMS AND CONDITIONS/ PAYMENT

Prices are listed in euros, and include duties and taxes (Portuguese tax rates), including VAT (Value Added Tax). The VAT rate applicable is that in place at the time of the purchase. Any changes to VAT rates will be reflected on product pricing. After this date, prices can be changed at any time.

Depending on national legislation, non-European countries may charge additional fees upon delivery. These fees may include additional taxes or duties.

Glamour Cristalino Unipessoal, Lda., reserves the right, at its own discretion, to change its product’s prices at any time, without further notice.

Products are billed at the prices listed on the website at the time of purchase.

Payment is made on the same date the order is placed.

Purchases can be made through PayPal or a secure platform. In order to complete an order, the User/Client must supply a bankcard number, explicitly consenting and giving Glamour Cristalino Unipessoal, Lda, permission to charge the amount corresponding to the transaction to his/her bank account.

The personal data supplied by the User/Customer, make proof of the order and all other previous transactions. The data recorded by PayPal or any other payment system/ platform will constitute proof of all financial transactions.

V – DELIVERY

Deliveries, via DHL, will take place Mondays to Fridays, at the User/Customer’s convenience (as stated as checkout). Goods will be delivered on the address provided by the User/Customer when ordering.

As a rule, orders should be delivered within 15 business days; however, in periods of greater turnover or over the holidays, this deadline may be extended to 20 workdays. The personal data provided by the User/Customer should be as clear and accurate as possible, so as to ensure the goods are delivered in good time. If we are unable to deliver the goods within 20 workdays upon purchase, without a valid justification, the Client/Customer can cancel the order for free. In that case we will refund you within 15 business days after dissolution of the agreement.

VI – RETURNS AND REFUNDS

Any returns will only be accepted if the product is in its original package and state, with no signs of having been worn or washed. For that reason, we recommend that our customers try on the shoes in a soft surface, such as a rug, as to avoid any possible damage or blemishes. If there is a problem with sizing, once accepted, the return of the product will be free. However, under the terms of international commerce, the Customer may be charged an additional fee. In order to return the product, customers should follow the instructions listed on the website.

Upon delivery, customers have 14 (fourteen) calendar days to return a product. In order to exercise that right, they must fill in the return form available on the website. Refunds can take up to 10 (ten) days, counting from the date the company Glamour Cristalino accepts the returned good. A 10.00 euro return fee will be deducted from the total amount to be credited. All transactions will take place using the credit card provided by the customer at checkout.

If the returned product is somehow faulty, damaged, or different from the model ordered by the User/Customer, all return expenses will be covered by Glamour Cristalino Unipessoal, Lda.

It should be noted that if the User/Client does not comply or agree with these Terms and Conditions, including the returns and exchanges policies listed above, Glamour Cristalino Unipessoal, Lda., ., will not reimburse them.

VII – ASSURANCE AND RESPONSIBILITY

Glamour Cristalino Unipessoal, Lda., has optimized the operational system in what concerns the User/Customer, including the access to the online shop, order validation and delivery to the customer’s address.

According to the laws in force, Glamour Cristalino Unipessoal, Lda., cautions that it is not responsible for any inconvenience and/ or damages caused by the use of the internet, namely viruses, malware, third-party intrusion or software and hardware malfunctions, as well as any other compelling reason/ force majeure.

In event of force majeure, the concerned party must inform the other party, within the following 15 days, through registered post with acknowledgement.

VIII – LEGAL INFORMATION

We inform our Users/Clients that exchanging personal data over the Internet may not be reliable. Internet users are solely and fully responsible for using it, and should take steps towards assuring and protecting their data from internet viruses and malware.

IX – PERSONAL DATA AND COOKIES

In compliance with Law nr. 67/98, from October 26, regarding the Protection of Personal Data, we inform our Users/Clients that Glamour Cristalino Unipessoal, Lda. is responsible for handling the personal data collected from the www.ritagoesby.com website. Personal data will be processed by computers and used for shipping, delivery, administrative, and statistical purposes. The data can also be shared with reputable third parties for marketing purposes. Users have the right to access, rectify, update, change or delete their personal data. In order to access their data, they must contact the company, listing their full name, address and User/Client number.

Users authorize Glamour Cristalino Unipessoal, Lda. to handle their data, using automated methods, including cookies.

In order to better serve customers, the website – www.ritagoesby.com – may use cookies,As a result, the Users/Customers won’t have to login every time they visit the website. As to optimize user registration, Users/Customers can resgister/ login onto the website by clicking the “Facebook Connect” button, If you select this option, you log in to Facebook, in order to get information on their Privacy Policy, as well as personal data protection, its use, rights and optional Privacy settings.

These Terms and Conditions are governed by Decree-Law no. 7/2004, of 7 January regarding Electronic Commerce in the Internal Market and the Processing of Personal Data, as well as by European Parliament and Council Regulation (EC) no. 2000/31.

X – INTELLECTUAL PROPERTY

All components, such as graphics, sound and technology embedded into the www.ritagoesby.com, website are protected by copyright, trademarks and patents. They are the sole property of Glamour Cristalino Unipessoal, Lda.

XI – APPLICABLE LAW AND JURISDICTION

The Terms and Conditions are regulated by Portuguese Law.

In case of dispute or litigation, any of the parties has the right to consult and appeal to an arbitration agency/panel.

Should a dispute concerning the interpretation or application of the current terms and conditions arise, or there are questions regarding the interpretation and enforcement of contracts signed on the website, any of the parties has the right to consult and appeal to an arbitration agency/panel. Other than arbitration, only the courts of Aveiro are competent to adjudicate with disputes arising or connected with these issues.
